Whether you do not have a Will or have not read through your Will for some time, it is very important to have an up-to-date Will in place and we are here to help.  

Your Will is your only opportunity to decide what should happen to your money and possessions when you die and if you do not have a Will in place you may not end up benefiting the people you want to as the law will dictate who will benefit.

Your circumstances may also change over time, whether through changes to your family or through marriage or the breakdown of your relationship and these can have very serious effects on your Will.

We can also provide tax advice and help minimise your tax liability.

Whether you believe you have nothing worth leaving in your Will or you have a vast estate, it is important to have a Will in place and we are here to help.

Lasting Powers of Attorney

We can never know what the future will hold and Lasting Powers of Attorney can help you prepare for the worst.

A Lasting Power of Attorney (often referred to as a LPA) is a legal document that allows you to appoint people you trust to act on your behalf as your Attorney should you no longer be capable of making decisions for yourself.

There are now two forms of Lasting Power of Attorney – one for your finances and property and the other for your health and welfare decisions. You can either have one or both forms.

The Lasting Power of Attorney has replaced the previous Enduring Power of Attorney. If you made an Enduring Power of Attorney, it cannot now be altered or a new one made, but it is still valid. However, if you wish you can make a Lasting Power of Attorney for health and welfare to supplement your existing Enduring Power of Attorney so your Attorney can make welfare decisions for you.

Once the Lasting Power of Attorney is registered with the Office of the Public Guardian, your Attorney are able to assist you and make decisions on your behalf, such as paying your bills and dealing with your income. The Property and Financial Affairs form can be used as soon as it has been registered, but your Attorneys can only make decisions under your Health and Welfare form once you cannot make decisions on your welfare yourself.

If you do not have or make a Lasting Power of Attorney and become mentally incapable of managing your affairs, then it may be necessary for a relative to apply to the Court of Protection to be appointed as a Deputy for you in order to have the power to manage your affairs on your behalf. Applying to the Court of Protection can be expensive and time consuming at a time of considerable worry and strain and it is often better to have a Lasting Power of Attorney in place just in case anything should happen as no one knows what the future will hold.
