Probate and Letters of Administration

We understand that not all Executors and Administrators require the same support when administering an estate and we provide a range of services depending on your requirements.

We can assist from completing the Inheritance Tax account and obtaining the Grant of Probate or Letters of Administration for you to completing the entire administration process on your behalf.

We charge by reference to the time spent. If there is the sale of a property involved then the conveyancing fees are applicable. Otherwise we charge at the basis of between £190.00 and £250.00 per hour plus VAT depending upon the grade of fee earner used and the complexity of the matter.

As an estimate, we would expect the cost for just completing the Inheritance Tax account and obtaining the Grant of Probate or Letters of Administration to be between £700.00 and £900.00 plus VAT, for a simple estate with no Inheritance Tax payable.

The exact cost will depend on the individual circumstances of the matter.
.
We will handle the process for you. This quote is for estates where:-
  • Our only involvement is in completing the Inheritance Tax account and making the application for the Grant of Probate/Letters of Administration
  • There is a valid will
  • There is no more than one property
  • There are no more than 2 bank or building society accounts
  • There are no other intangible assets
  • There are 1-2 beneficiaries
  • There are no disputes between beneficiaries on division of assets. If disputes arise this is likely to lead to an increase in costs
  • There is no inheritance tax payable and the Executors do not need to submit a full account to HMRC
  • There are no claims made against the estate
We can also provide a full service, including obtaining values for the estate, completing the Inheritance Tax account and Court application, collecting in the assets, preparing estate accounts and distributing the estate, and that service will be charged based on the hourly charging rates quoted above.

On top of our fees there are a number of disbursements, which are payments that are made to third parties and these are in addition to our fees. They can include:-
  • Probate application fee of £273.00 plus £1.50 for each certified copy of the Grant.
  • Bankruptcy-only Land Charges Department searches (£2 per beneficiary)
  • £200.00 approximately Post in The London Gazette and in a Local Newspaper – Protects against unexpected claims from unknown creditors.
Potential additional costs:-
  • If there is no will or the estate consists of any share holdings (stocks and bonds) there is likely to be additional costs that could range significantly depending on the estate, whether the share certificates are available and how it is to be dealt with. We can give you a more accurate quote once we have more information.
  • If any additional copies of the grant are required, they will cost £1.50 (1 per asset usually).
  • Dealing with the sale or transfer of any property in the estate is not included.
How long will this take?

Typically, obtaining the grant of probate takes up to 16 weeks, although that is based on the Probate Registry taking up to 8 weeks to process the application. Collecting assets then follows, which can take between 12 and 24 weeks, depending on the types of assets. Once this has been done, we can distribute the assets, which is normally done within 4 weeks of all of the assets being collected in. This is only an approximate guide and if the estate involves property which needs to be sold, foreign assets, shareholdings and more complex matters and assets, these can take much longer to be dealt with.
